Has anyone seen this? Scam or legit? I can say from my experiences with the company a lot of what is outlined in the link is true and happens daily. Especially with salaried executives.

I was, recently terminated for this very same issue. Everytime we have a visit, the mgrs. freak out & slave us away. I was a part timer & would leave in time to pick up my Daughter but because of a visit, my boss asked me to stay longer. I asked her if I can skip my lunch & leave earlier, she said, DO WHAT YOU HAVE TO DO JUST MAKE SURE YOU HAVE AN HOUR OFF ON YOUR SCHEDULE. I clocked out for the hour but worked it to help her out. I left an hour early, compensating for my lunch & they fired me. My boss signed my timesheet because of previous teXt messages where she messed up & removed hours from me. Later I find out that the company is suppose to pay me every time they text message work related stuff off the clock, which she did numerously & they never paid me for it. How true is this article?? I need to speak to someone asap.

Been working off the clock for the last 3 years. Before I clocked in, during lunch break, even after I clockout. Upper management expect me to take ownership of my job. If I don’t complete my job in a timely manor I would get written up. Doesn’t matter if lack of bodies, lack of equipment, space, broken equipment. If they don’t like you due to age, handycap, they will write you up, then terminate you in 30 days. They start micromanage you. So you start doing it their way and it still won’t make a difference. You don’t have the regular positions to support your expectations.

Hourly Employees Often Forced to Work Off the Clock

Companies are legally required to pay hourly employees anytime they do any type of work related activities. This includes being on duty during meal breaks, opening or closing the store, running errands and working from home.

Macy's stores are accused of frequently making hourly employees perform tasks before they clock in, during their meal breaks and after they clock out.

Salaried Managers Denied Overtime

Salaried managers are not supposed to primarily perform regular employee work like checking out customers, cleaning the store and stocking shelves unless they also receive overtime pay.

It's alleged that many Macy's locations call an employee a department manager but still require them to do non-manager work such as helping customers or working check out..

This allows the stores to save money by making their managers work long hours without paying them overtime.

If you worked off the clock or were not paid overtime, you likely qualify for a claim.

You likely have a claim if you:

Often worked during your meal break.

Worked off the clock before or after your shift.

Were a department manager but spent over half your time doing non-manager tasks like working the cash register or helping customers.

Commission Employees Not Paid Minimum Wage for Non Commission Work

Commission employees must receive at least minimum wage for time they spend doing work where they cannot earn a commission, such as cleaning or taking inventory.

Macy's may have required commission employees to perform cleaning, restocking and other duties where it was not possible to earn a commission during that time.

These employees would be eligible for a lost wages claim if they did not receive minimum wage during the hours they spent performing these duties.

So, if you are a MTM or an OAPM (literally the two worst jobs in stores at Macy's), then you are supposedly an executive employee and such exempt from over time for hours worked in excess of 40 each week. For MTM's, we usually work anywhere from 50 to 60 hours a week. For OAPM's, you have to include all work done at both home and in the store, we also average 50 to 60 hours a week.

While these jobs have "manager, in their titles " most duties don't meet the FLSA's requirements for an executive employee, which will entitled people who sign up for the class action suit to overtime pay and back overtime owed by the company. If you are a MTM or OAPM, ask yourself the following questions:

Does your job mostly consist of managing the company or a department or do you spend the majority of your time doing physical labor? MTM's spend the majority of their time working truck and not supervising others.

Do you supervise at least two full-time employees? Many OAPM's don't meet this requirement and technically are on call 24 hours day and most put in 50 to 60 hours a week trying to do what used to be the job of two supposed executives. Doing alarm testing, working in fulfillment, working in AP rooms, helping to unload trucks, placing goods on the sales floor, cabling merchandise, doing audits, working reverse logistics, and all of the other physical work is not supposed to be the majority of what you do each day.

If you have answered "no" to just one of these questions, your employer is supposed to pay you overtime for hours worked in excess of 40 each week. As the company continues to trim hours, cut jobs, and push everyone to do more with less, the expectation for these mid level "managers" to work crazy hours and do all of the physical work by store managers is becoming more and more frequent in our stores.

Now I know why they recently reinstated the Visual leads back to managers. About three years ago they illinated the "Visual mgr" from alot of stores and made position a "lead".. Although the job responsibilities didn't really change.
