Age discrimination class-action lawsuit

Just read an article about former IBM employees who are going after the company for age discrimination.

Any ideas if former Oracle employees could do something like this? Would anybody be willing to?

One of the reasons that oracle is so very, very careful to avoid triggering WARN is because it requires it to provide a list of everybody laid off with position and AGE. Oracle very purposefully seeks to minimize its legal expose with regard to age discrimination by maneuvering around WARN. But have no doubt that oracle practices age discrimination to the max to reduce costs, current and future.

I was laid off at age 65 a couple of years ago, and was pretty fired up to read the layoff list showing age, gender, yadda. Assuming it was truthful, I saw nothing to indicate a targeted demographic in that event. Frankly, after 18 years of Oracle, I was not unhappy to go, just a bit unsettled until I changed to accomodate my new circumstances. Excelsior!

To start proving age discrimination you’d have to know the distribution of number laid off versus number kept for each age cohort. It only starts to get interesting if lay-offs in a particular category, e.g. software developers, shows a statistically much higher percentage laid off versus kept in older age cohorts. And even then there may be other factors such as performance involved.

You want to claim age discrimination?

Oracle is being sued by the federal government for alleged discrimination against black, Asian and female employees. It would hardly be a surprise if it was at least pushing the boundaries on age as well.

When a friend (in his 60's) was laid off, his employer provided him with a list of everyone laid off versus retained by age for each grade.

There is little doubt in my mind that Oracle is engaging in - amongst other things - age discrimination. But, if people want to go the ageism lawsuit route, they have a stark choice to make: Oracle will only pay you severance if you sign a waiver that you won't sue for age discrimination. So if you're getting a chunk of severance, you risk getting nothing if a lawsuit fails. The sad reality is that big companies like Oracle - with its legion of lawyers - hold most of the cards in situations like these.

DO it gzw!! I'm 64 and no idea if I'm in line for a RIF. I dunno, google it, see if there is anything brewing regarding age discrimination - if LE actually said those things, I can't believe lawyers aren't already lining up to sue.

In your 60s, options for re-employment are vanishingly small.

Oracle let me go @ 65 years old, after 10 years with the company and I was working on cloud development. This happened a few weeks after the big employee meeting when Larry explained how they wanted to fill all their positions with younger folks. I am in on age discrimination.....

IBM really did discriminate against older employees and they didn't take precautions to mask the actions. If Oracle is discriminating (not convinced they are), they are not making the same mistake. Good luck.
