Working off clock

Did anyone ever have to work off clock? We were working overtime in my department and now all the sudden we have to adhere to a 40 hour work week no more even slightly or our time will be rejected by management. Is this legal ? It seems now ot is for "elite" if you get my drift. Our big boss was in last week too so we think that had a large part to do with this.

My thought is your question and statement have a few things that come to mind. If the business does not currently require teams to work beyond the 8 hour workday based on client objectives, demand, and volumes then yes overtime must be communicated and approved if the time is worked. The line of business has the right to reduce overtime requirements or not utilize OT unless a immediate need came forth.. if an employee is working beyond the work hours required and there was not a requirement or approval provided then it sounds like failure to adhere to the direction provided. But then it may be a case that the direction is not fully clear and would suggest discussing with your team if that is the case...It sounds in your case that teams are being told there is not an overtime need for the group as a whole currently ..., though I agree the employee should be paid for any time worked but they should also make sure they are not working overtime at their own choice when it was not required or asked by the business . If you are being asked to work OT and your not getting time approved then that is not permitted. I

Another great strategy by the management , way to go.. frustrate the hardworking employees even more so they quit in frustration ! Way to go what a downer !!

We were told o t needs to be approved. If they say no, I go home. This multi-national Corp. Doesn't need my charity work when the CEO is still taking his huge bonus. And it is illegal if they ask you to work off the clock.

are you exempt or non-exempt? (i.e. - do you get paid overtime?)

If you're non-exempt and DO get paid overtime, they can't do that, violation of labor law, at least in New York state that's for sure.

If you're exempt and don't get paid overtime, really makes no difference since the timesheet is really for internal billing purposes but it certainly is not very ethical.
