SUB Pay and New Job - Honor System/Keep it?

If I get a new job but continue to keep my sub pay there is nothing that says there is a penalty for doing so. Only that I "may" be required to pay it back. So if I just save it and toss it into a MMKT account and they come after it, fine. If they never do then no loss. Anyone shed any light on this??

This is a Settlement to go away more than a paycheck. And if they are not withholding SS and Medicare it isn't necessarily W2 Income.

Does state unemployment in fact notify the company? The answer to that is really the key point to this discussion. I didn't think they did, but on second thought, maybe. Any thoughts?

Do you remember when the HR officer was reading you your rights? How you may be eligible for unemployment and you should file quickly?

My thought is not to apply for UBenefits because when you do finally get a job you have to notify the state and you don't want to mess with them. In turn, the state notifies the company you have canceled your UBs. That triggers a call to TMS to see if you also canceled your Sub Pay.

Don't file for UB and roll the dice!

What action could they take? Give it back? Fine. Don’t spend it for a couple years. This is a settlement, not a paycheck. Instead of a lump sum they spread it out to hopefully get people to cancel it.

And if you don’t claim unemployment during the pay then how would they know? Stay off social media. Worth it.

I would NOT take the high road, sorry. What do you expect HR to say? And what if you don't contact TMS within 3 business days, CHarlie is going to come to your door and throw you in jail? I'd milk it for everything possible.

Yes to it all. Yet I would take the high road had I found F/T employment during my SUB.

I called HR and I asked them explicitly if I got a new job does this Sub payment go away and he said yes you have up to 3 business days to contact TMS...

I had a lawyer review it. He said legally they could go after you if somehow they found out you got a job … but it was unlikely that they could find out independently since TMS does not check against state unemployment (nor would state unemployment give out that info). Even if they did, unlikely they would try to take action against you. Still, there is a potential small exposure … but definitely worth taking.

As it’s all brand new to me can anyone tell me if during the claiming process do you have to confirm by law that you don’t have new employment? I am not seeing anything other than a fear tactic (suitable to BNY) to make you think you should tell them. Might be worth a half hour with an attorney to confirm.

I believe there are some rather arcane legal measures of this 'SUB' scheme. It seemed to me it was the honor systems as well after calling this TMS company and asked them just that. I'd keep claiming it after each bi-weekly paycheck even after getting a new job.
