It is true that the WARN act does not apply to those discharged for cause. HOWEVER, THIS WAS A MIXED TERMINATION - NOT ALL EMPLOYEES WERE TERMINATED FOR CAUSE. THAT IS, SOME INDIVIDUALS SUCH AS THE EXECUTIVE EC'S, MET THEIR GOALS AND WERE TERMINATED. FURTHER, OTHER INDIVIDUALS MET THEIR GOALS AND WERE TERMINATED BECAUSE OF THEIR PAY SCALE. For that reason, it does not hurt to check to see if there was a violation.
