So since the DOL doesn't have an enforcement role, that would, by your logic, necessarily preclude the individuals from suing under the act? Right? Because if the DOL isn't holding their hands the former employees cant get a lawyer and sue to enforce their rights under federal law in COURT? Its a good thing you went to be a "lanman" with your law degree instead of an actual attorney.
