Thread regarding Follett layoffs

OWBPA - older workers benefit protection act

The OWBPA mandates that an employer provide a list of job titles with corresponding ages to all laid off employees. On November 8 this list was provided to over 40 laid off employees. On November 14 a revised list was sent out to over 40 employees laid off with a request that they sign a new severance agreement and mail back to Follett. Why was this done? Because someone in HR decided to add more employees at the last minutes for reasons I can not state here. Needless to say this action has come back to bite them in the ass!

You can't base pay on seniority then cut based on pay without cutting based on seniority. If you're cutting, based on seniority, you're cutting based on age, too. One can't earn 25 years tenure without being over 40. Those over 40 are a federally protected class of employee. I don't see how that layoff could possible be legal.

I don't need ben gay and I'm not that old but I do care for some of the people that are and what Follett did has yet to be determined if it was legal, that decision will be left to the courts.

You prove age and maturity don't always go hand in hand, and if you are at Follett it just shows that professionalism had nothing to do with who they kept and who they let go.

Many unethical companies try to use layoffs to cover up numerous forms of discrimination. They count on employees being distraught and needing the money the severance offers and not questioning the reason they were selected.

They did the same thing when I was laid off last April. I know of at least one employee who appeared on the first list that was not laid off.
