I was told that our severance agreements may not be valid. Apparently the fact that they did not make clear the word "seniority" could in fact make the contract invalid. If it is found that they in fact laid off people with the least and people with the most seniority would make the use of the word "seniority" misleading.

I spoke with attorney who thought that a class action suit was possible, but individual cases would be difficult to prove.

I'm not sure how to contact an attorney for the purposes of a class action suit. Ideally, the attorney could post an ad on this page and provide a confidential way to contact them. There must be 100+ people in the class. The attorney would make some serious money on this.

If someone spoke with an attorney explained the situation then use that attorney as the point of contact for everyone who thinks their layoff was discrimination based. Post the attorney's name, phone number and email on this site as well as other sites. Once the attorney has enough information he/she could let us know how to move forward with lawsuit.

Eliminating a position is a favorite ploy. Then create a new slightly different position. I've seen it done over and over. Or move someone to a new position wait six months and eliminate the position.

I have been researching this also. Was going to find a local attorney but thought it might be better to have one located closer to the home office in Illinois. I wish there was a way that we could anonymously come together as a group because I am sure that most of us have the same story. I was over 50 when I was laid off in November. Had been in the same store for over 20 years as assistant manager. Definitely wasn't the last person hired but was the first to go due to my position being "eliminated". I had a glowing personnel file full of awards and praise. Any advice or information would be greatly appreciated.
