Thread regarding Corinthian Colleges Inc. layoffs

Labor Violations?

Since the headquarters for ECPO is in CA, if someone were to report a labor violation for CCI, would the labor laws be for CA or the state the employee resides in? Also, is CCI required by law to pay out for vacation hours?

25374 - The decison to not pay out accrued vacation is not a CCI policy (in fact, I belive that others who left recently DID receive a payout for their accrued vacation - as I did). Rather,I am speculating that the company's declining revenues and cash may lead executive management to take this action for future terminations. Legal or not, I believe these dollars are at risk for those who are let go in the near future. I was not here when the vacation policy changed. Did they completely eliminate ALL accrued vacation, or just stop accruing from that point forward - or something else......

25301 can you explain that policy? I have 100 hours of vacation just sitting around waiting game to be used or cashed out...not sure how that isn't accrued vacation.

Anonymous25301- Employees are essentially the first unsecured paid. Sure the legal fees (bankruptcy court/lawyers) are ahead of employees, and there are a few other special situations that don't really apply to CCi, but employees usually get what is due, sooner or later.

Let's assume that CCI conducts a layoff and chooses to not pay accrued vacation. Even if your states requires the payment of accrued vacation at termination, you still have to collect. Event if you win a judgment in court, you still have to collect. As an unsecured creditor, you will be at the end of a long line of organizations who want thier money. Many of these organiziation are secured (collateralized), and will be paid their money (or x cents on the dollar as negotiated - or determined in bankruptcy court)before unsecured creditors. The only business motivation (thiere is clearly no moral or ethical component in our sernior management team) to willingly pay accured vacation is the avoidance of yet another libility that might potentially deter a sale. Moral of the story: don't count on it......

Good luck on labor law enforcement. Yes vacation has to be paid unless there is no money. Call an attorney and state and ask if you have a case. If an lawyer won't take it then you are SoL
