Here is the real scoop. CA AG is NOT backing down. She plans on running for governor at some point and would LOVE to put CCI out of business and she will. Another reality check, NONE of the potential buyers were serious but simply went through the motion to keep the DOE happy.

Some here would like me to believe that the buyer has been living under a rock for the past 6 months and wasn't aware of the presence of liabilities until recently, after spending 2 months in negotiations. This doesn't seem realistic to me.

CCI isn't getting sold because the liabilities won't go away. The new purchaser is going to get all the outstanding liabilities. Thus CCI is going out of business.

Boy this rumor sure has legs. I first heard this rumor Friday and today someone came up and said the White House was involved in getting the AG to approve the settlement. This is nothing more than a rumor that has no basis in fact. Things are moving fast and I will report more after the IT town hall meeting this week or if anything else comes up. Oh and the CIO, Andrew, did not resign. That was another rumor today.

Agreements are usually transacted upon between people using human language before being transferred to paper. The transferal requires a considerable amount of time and is not completed at the same time as the verbal agreement. But keep saying BK. It's amusing.

Sooooo ... for all of the rocket scientists out there ... please consider the following. During this process numerous legal liabilities have been discussed and resolved. Have you seen any court resolution and/or docket that indicates that the resolution has been agreed upon? Did not think so.

In addition, in almost every case, the liability that is being discussed has to do with transfer of liability at the point of sale. The discussions have nothing to do with the suits brought against CCi. They are focused on the potential buyer only. Therefore, the suits against CCi will still exist and will not be resolved upon the point of sale.

Lets stop with the conjecture and deal with facts. Will CCi file for BK -- who knows -- but the odds are leaning yes. The odds are that they will at the conclusion of selling the assets. Once the assets are sold there is no longer a revenue stream. Is there a sale -- who knows. However, the odds are leaning towards yes. We all know who the buyer is. We all know that the buyer has conducted audits as is moving forward.

Just hang in there.

I was told on Friday that it was settled last weekend. Verbal agreements Don't require a docket number. Once the lawyers hash it out then it will be a legal document for the court to approve.

BK is a done deal. CCI isn't getting sold. CA hasn't settled and peddle that nonsense somewhere else. If CA AG settled the case then it would not still be on the court docket.
