Ask her what she is writing. Get a pen too!

I wonder if my manager has a pen that records. I've noticed recently that when she is testing me with one of her many questions she pretend writes. I'll have to look closer.

Great! Lawyers will only attack low hanging fruit. The more you document the less they have to work and therein is the low hanging fruit. You are entitled to a copy of the items in your file detailing your hiring, reviews, pay, pay raises and discipline. You are entitled to review the entirety of your file. Do it. Note unsigned disciplinary notices. Note calls regarding behavior where you were never talked to. To any negative items, document your side of the story and add it. The more you can show you've done, the better the chances are that Follett's lawyers will want to settle. Continue documenting and please share your progress.

I have a recorded conversation with my boss and HR generalist. The boss admitted to saying things which they now deny.
