The Worker Adjustment and Retraining Notification Act (WARN Act) is a United States labor law which protects employees, their families, and communities by requiring most employers with 100 or more employees to provide 60 calendar-day advance notification of plant closings and mass layoffs of employees, as defined in the Act. In 2001, there were about 2,000 mass layoffs and plant closures which were subject to WARN advance notice

An employer who violates the WARN provisions is liable to each employee for an amount equal to back pay and benefits for the period of the violation, up to 60 days. The liability may be reduced by the period of any notice that was given and any voluntary payments that the employer made to the employee, sometimes referred to as "pay in lieu of notice."

U.S. district courts enforce WARN requirements. Workers, representatives of employees, and units of local government may bring individual or class action suits. The Court may allow reasonable attorney's fees as part of any final judgment.

They have known about the drop in oil prices since June. There was plenty of time to plan and Warn and they haven't disclosed anything

The guys in Alice Frac have a class action law suit. I have processed payroll for many years. When the housing market hit a bottom I had to pay 150 employees under the WARN act due to the company giving no notice. Even though they were paid a severance I had to calculate 3months pay for most. Some got more.

WARN protection may or may not matter. On the Dept of labor website:

EXCEPTION TO GIVING NOTICE

Is an economic crisis considered to be an unforeseen business circumstance?

If an employer believes their situation is the result an economic crisis, it may apply the unforeseen business circumstance exception; however, there could be a burden on the employer to prove why it could not plan 90 days in advance.
