Why can't Dell layoff H1bs?

It feels like US Citizens regardless of race are being targeted for WFR at dell and why cant the H1bs be sent home as there is no need for them with the diminished opportunities. It just doesn't make legal sense.

Most h1Bs at Dell are very d-mb & not productive. Many need help to do their job. They are mostly hard working & loyal. They are paid low salaries.

Yes there are a few very talented h1Bs mostly in prod grp.

My understanding is that almost all h1Bs are protected from layoffs.

They can, but it’s a numbers game. They pay the H1Bs less, that’s the whole point,l - the “highly skilled” thing is a meme and everyone knows it.

They can get 2-3 Indians for the price of 1 American. And those Indians are slaves to the company because it can get them deported any time it wants.

It’s an economic relief program for corporations and always has been. Until we stop accepting politicians lying about the quality of H1B labor, the scam will continue.

That’s why the recent hundred thousand dollar fee is a good start. Take away the economic factor and no one will hire them.

@gd Dude, I work with Devs all day long and a large portion are Indian... Many of which are very difficult to understand but once again... they are CHEAPER to employee than a US citizen. 1 US employee = 3 Indian employees..

Most of them are rude as he-l, demanding and wnat everyone to "do the needful" but, do you really think dell gaf about that? No. All they see is dollar signs and how they can get the most for their money.

@ca lol no it isn't. The US is a MASSIVE country dude. It literally all comes down to cheap labor, and that's it. Hiring a fully qualified US citizen is 10x more expensive than hiring a semi-qualified, or even fully qualified H1B.

My manager was telling me last year that for the most part, promotions are only going to India, Mexico and other poor af countries because they can promote 3 mexicans or indians for the price of ONE US promotion.

The perception that U.S. citizens are being disproportionately affected by workforce reductions (WFR) at Dell — or that H-1B workers should be sent home instead — overlooks how employment law and business realities actually work.

First, layoff decisions must follow U.S. labor and anti-discrimination laws, including Title VII of the Civil Rights Act and the Age Discrimination in Employment Act. Employers cannot legally base layoffs on race, nationality, or visa status. Dell and similar companies face significant legal risk if they were to favor or target specific groups. Layoff decisions are typically driven by business strategy — like eliminating redundant roles or shifting resources to growth areas — not citizenship.

Second, H-1B visas are tied to specific job roles that the company has already demonstrated cannot readily be filled by a U.S. worker at the time of hiring. If an H-1B worker’s role is eliminated, their visa status automatically becomes uncertain — they generally have 60 days to find another qualifying position or leave the country. So the system itself already limits “job protection” for H-1B holders.

Finally, reducing H-1B employment doesn’t necessarily mean more jobs for U.S. citizens. Many of those roles involve global operations, specialized skills, or teams distributed internationally. If Dell (or any major tech firm) can’t fulfill its talent needs domestically, it may simply move more work offshore rather than rehire locally — which can further limit U.S.-based opportunities

People are really tiny percentage compared to what kind of dollar the European (and the rest of the world) companies bring in. Please expand your horizons. ;)

why more and more people asking what is to do with minimum wage for h1b and other visa holders ?

reality is - Minimum wage for any given visa type is not just number but it is tide to broader macro economy. This is the number which balance out work force participation and this is the only number which protects local workforce participation.

all problems are due to this minimum wage number.

why all these cheat executives able to replace US citizens and hire temp work visa folks?

Rule says - if you pay someone 60K or higher, you don't have to search for qualified US citizens. basically once you ready to pay 60k means, they will be treated same as US citizen for hiring process.

why there is no minimum wage for TN/L1/H4/L2/OPT/CPT etc..?

what a game !!! this 35 years old minimum wage number must be changed to 200k or higher for all temp work visa asap. if any politician or administration representative tell u that don't worry, we will fix it other way then don't even bother listening them as their goal is to fool around.

Ask to fix this minimum wage number for all temp work visa folks and everything else will be fixed by itself.

One report which is more than accurate most time says ,

If h1b minimum wage changed from 60k to 150k on day one of this administration, within 6 months 20 million Plus jobs freed up.

Why administration did not do that which fix 99% issues but do expensive side way rules which says it all. no one want to fix anything. its just money and power game.

by the way Texas is state for most conservatives and RED since it's history known. How come Texas has highest number of h1b ( 381k ) compare to any other state. Even CA with 40million population has same number and NYC with 8 million has same !!! which says it all.

Why Florida has only 6k H1bs but 18k TN visa and 12k L1 folks who do the same type of work. This 1 to 3 ratio is same across the board. Same for even CA and NYC too. why just blame H1b but not TN and other side ways visa like H4/OPT/CPT/L1/L2 etc..

TN visa folks are highest numbers in USA soil and can do any work ( unofficial) as they are not bound to any employer or strict job duties. Even restaurant guy is on TN visa. Worst their spouse can work any job any hours any employer like US citizens. same goes for h4 and l2. worst all those are unlimited in numbers. more than h1b, US citizens are losing jobs to those side ways cheaters.

JD/Rubio or any one from administration, want to have open debate on these ?

people are not stupid. Upcoming midterm is all about h1b and all side ways visas. looks like people are saying you guys are done and dusted. have you ever asked president regarding his side ways deal with folks regarding mid term and 2028?

This is all by design. lets ask few questions to fake representatives of Administration and Congress ( House/Senate):

  1. why minimum wage level for h1b is not increased since 1990. Those days senators were making 56k and h1b was 60k. fast forward today , senators making 180k but h1b is still 60k. if u add benefits, its like senators making 250k but h1b still 60k minimum.
  2. JD, who is stopping u to change minimum wage limit? no one. Lori ( labor secretary) just need to publish rule with 30 days comment period and done. why you did not do that on day one but waiting for two lotteries under your watch completed? is it due to mid term deals? you are making babies but others are struggling to pay rent. why ?
  3. Why not mandatory site visit for every h1b and see they are doing what they submitted during LCA ? why tons of folks working at gas station and inline for green card via h1b route ? why tons of ladies working as QA /BA /PM/Bank teller/CSR etc.. on h1b?
  4. Why no same wage limit for L1 as h1b ( even though that is lower too) ? why l1 is unlimited in number?
  5. Why TN visa exist where USMCA is almost not exist?
  6. Why no tariffs or digital license fee on IT outsourcing firms where its just require nothing and can be done within minutes by commerce secretary's will ?

Genuine h1bs' are good ( not side products like - h4,opt,cpt,l1,tn,l2 etc..) for country. don't blame those folks. Blame corrupt executives and cheat politicians only. Both want to stay in power so they are doing Bait and switch. They have dirty deals with donors before election, say something to people to get their votes and flipped 180 degree once election over. its nothing more than that.

Some H1B's bring skills that domestic employees cannot provide.
A lot of people don't know this, but this is regulated by the Dept of Labor.
Of course it's exploited and there are ways of getting around the rules, but for a sizeable amount, the skill sets coming in on H1B's are to backfill the deficit of those skills in the domestic employment supply.

On top of that, it adds greater diversity to the employee base, which is valuable to a global company like Dell.

bottom line, companies and governments make more money from these control mechanisms which gives them power to exploit.
for H1B, workers can't easily switch jobs, that simple, so they can be paid less, many times having a masters degree getting paid less than a less educated, flight risk, US coworker. so in a pure output and profit machine, gray areas and control equal profit. hiring more h1b means cheaper flc, better educated, won't leave for bad conditions.
similar to illegal aliens, they get abused and demonized for doing hard jobs at less money, they are paying into Medicare and ss without the legal ability to ever use that, so it actually benefits us citizens in that way, remember, government enabled that, they have w2s, loans, housing, car insurance, not hiding in tents and cash only, so gov enabled all that, and now wants to drive them all out suddenly, so weird.. also, I never understood why h1b workers or these other immigrants get blamed for (insert any issue here) when it's the corporations hiring them, gov allowing all these loopholes, they started it all, they continue it all, for the explicit purpose of exploitation/profit. workers trying to make money and have a better life but blamed for whatever issues of the day by their overlords. maybe blame, fine, jail the company instead? take away the carrot and the workers will leave. workers just working (immigrants statistically commit less crime per capita from us citizens) are caught in a bad way, it's all crazy..

@a6 This is a pretty misleading statistic (.33% of total jobs). The relevant percentage is the proportion of white-collar workers at a tech company like Dell. It has to be orders of magnitude greater than your statistics because there were people everywhere from India, Brazil, Panama, Slovakia, etc.

As others have clarified, there is no laws protecting H1B from layoffs and they happen. The saddest part is the kids, some of the are born (US citizen now) and raised here and suddenly need to leave to a country they never felt a part of

Like everyone is saying here, it's all about the dollars. People coming here and pleading for change will fall on deaf ears. Dell layoffs have been happening for over 5 years. Eventually, it may stop. Realize that life in the US for Tech workers is changing and not for the good. Financially plan appropriately.

I had a friend on H1B that was let go, so no one is immune. I think the premise of the H1B visa is BS. Just say, "we're going let let in x0,000 people with engineering degrees" and be done with it. Quit pretending it has anything to do with critical skills shortages.

As much as I agree with you, this bottle is open and there's no putting the genie back in the bottle. Cheaper labor and they put in the time. Two things companies want. I don't like it, I think it adds to the US Unemployment and the US folks can do the same work. That alone should tell you that US companies don't care about employees, it's all about profits. Plain and simple. All the more reason there needs to be some sort of union for professional workers to help out with this. I know the debate that comes with the union discussion but we need someone with some power to aid us. Your local congressman could care less as they probably get money from the corporations. It's a viscous cycle.

Why not to cancel all cheap bodyshops in Europe, India and China? I literally heard manager saying I'd rather hire someone in Slovakia for 60k because I could hire 3 people for the price of one I8 in RR. This is the reason - offshoring. H1B folks are cheaper, but still helping US economy with taxes, people abroad are pure loss for US economy.
