Has management explained why the WARN Act does not apply to the FSAs and Assemblers let go today? Federal law requires 60 days notice with plant closures or layoffs of more than 50 employees. Why does the WARN Act not apply to the layoffs today?

Only being paid 2 weeks severance not 8. No notice just walked out the door. Insurance is cut off in 3 days.

File today. If you sign an agreement that severance was paid in lieu of notice, then benefits may be delayed 60 days. The April agreement did not say that severance was in lieu of notice and people collected beginning the first full week they were unemployed.

By law they're required to give employees 60 day notice of layoffs. By paying us 8 weeks, they get around this law. It's called pay in lieu of notice. It's not them being compassionate, it's just them avoided lawsuits.

They can give you a 60 day severance payment in lieu of the notice. That's why people get 8 week severance, in that case they do not want to file anything.

It is sad that so many co-workers lost their jobs today. Tonight, literally thousands of our friends and neighbors have lost a source of income to help support their families. Tragic.

The WARN ACT applies to the number of employees terminated per location. The number of terminated FSAs, Assemblers and (potentially) Internet Fulfillment employees combined (per location) does not equal 50, hence no warning was necessary.
