@OP, I've read your thread on the latest post section. I work at Charles Schwab, things are pretty hectic there as we are expecting significant layoffs for a while now, and I'm really sorry to hear you are experiencing the same. Have the layoffs already started at your place, or you are still waiting another shoe to drop? As for your question about WARN, I'm not really familiar with the CA laws, but you can check these three hashtags #WARN #SixtyDays #SixtyDaysNotice , someone probably covered CA as well.

Sounds like to preemptively *skirt around the #WARNAct * #WARN simply by how they structure the sales organization.

  • Deliberately creating unattainable sales targets across the board, so they than can just pick and choose who goes no matter the real performance
  • Hiding behind that regular rotation performance firing cycle to never have to report proper Age profiles via #WARN #WARN Act filings

By law they're required to give employees 60 day notice of layoffs. By paying us 8 weeks, they get around this law. It's called pay in lieu of notice. It's not them being compassionate, it's just them avoided lawsuits.

The Warn Act does not apply if 1) Less than 50 workers at a single location are let go; 2) If between 50 and 499 workers are let go at a single location and this represents less than 33% of the total workforce at that location.

In other words, for the Warn Act to apply you need > 50 people and greater than 33% of the workers at a single location let go.

The 60 day assumption is wrong - if they give you 60 days severance that counts as an effective and timely notice.

So, you can be let go tomorrow without a WARN notice if you are given 60 day severance - they would be responsible for paying your benefits during the 60 day period too. You will not be able to get unemployent benefits during those 60 days... Search this site, use "60 days" keyword there is a ton of posts on thia topic.
