Thread regarding Cisco Systems Inc. layoffs

Unemployment Benefit in California - Please discuss here

for those who took the WTO aka voluntary leaving, are you applying for unemployment benefits. California law does not count severance for purposes of unemployment, it is considered as payment for past services. I am planning to apply, wondering if i should apply after receiving severance.

main issue is we will count as layoff. if majority of is over hundred or thousand apply EDD will know something is wrong and this is a layoff though cisco denies this is a layoff. clearly email says if i do not take nov 23, i will be notified in next round for voluntary most likely which is yes.

there is a chance we may not get job in next several months due to covid and we will lose on pandemic assistance also if we do not apply now.

Neither your ex manager or Cisco HR will know you took unemployment. and no need to feel apologetic. Cisco would have forced if one does not take ER ER is just to avoid age discrimination. cisco is not a charity except for BLM folks. also as californians we pay b—s— amount of tax and unemployment tax for dozens of years so no harm in so called milking the system. a wretched state and cisco CR takes in millions. c-ap

Does it get back to your ex-manager that you applied for unemployment benefits or is that strictly an HR thing and relatively confidential?

Oh, yes I took the ER and am RETIRED, not UNEMPLOYED......

I'm glad you were able to RETIRE. I was a year short of the required age plus years of service, so I was ineligible to take the program. There is no way I could retire at age 55. Well, I could, but my retirement savings would be gone in 10-15 years, so I need to keep working for 10 more years unless I want to drastically lower my lifestyle.

But I'll argue that choosing to take an ER package vs. getting a smaller involuntary package a couple of months later in a pandemic where it's harder to find a new job is not a choice. It's making the best choice between two options.

All you people taking the ER snd then trying to get unemployment are being unethical. You chose to leave. Trying to game the system and s— on the tit of government , when there are people who are really ‘unemployed’, is really pathetic. You chose to leave and you don’t deserve unemployment. Leave those benefits for those who lost their job - not for those rich CA tech workers who are just trying to get something for nothing. You are all losers.

I am trying to apply for UI. I see below under 3 & 4.
Under Last Employer Information,
Does anybody reported severance as mentioned below in item 4?

  1. Reason for no longer working-

Seperation Category - Laidoff/No Work
Seperation Explanation-Reduction in WorkForce

  1. If you received, or if you expect to receive, any payments from your very last employer or any other employer other than your regular wages, report the payment below.

Employers may provide their departing employees monies in addition to regular pay accrued through the last day of employment. These monies may be vacation or holiday pay or payment that the employer may refer to in a variety of ways such as severance, in-lieu-of-notice, WARN, incentive bonus, etc. All of these types of payments should be reported to the EDD because certain payments are considered wages that conflict with unemployment insurance benefits. If you received any of these payments, check the appropriate box and indicate the amount and the dates it applies to.

Good advice about waiting. And yes - everyone should apply from Cisco who was ERed or LRed. There is only one relevant EDD question that folks are fearful of, and that's "Why did you leave?".

You will not be asked whether you resigned or were fired or laid off, but answer a simple multiple choice question ticking "Workforce Reduction". You will be telling the truth and get your benefit.

getting a severance payout is a strong proof this was layoff. No voluntary termination/resignation will give severance, so wait till severance paid out and then file. stringer case.

wait several weeks after you have received all your payouts. There is a question to respond to that asks if you have received any payments in the last 2 weeks. I don't know if responding yes would disqualify you but I applied about a month after CEP (ER) and have received several deposits in to the BOA debit card.

I agree just do it, but I would also suggest setting aside those amounts in the event state comes back to claw back the amount citing you are disqualified/ineligible to receive.
