The Oregonian: "Jury awards plaintiff at least $7.5 million in punitive damages in s-x discrimination lawsuit against Nike"

I'm glad the boys' club is finally getting the reckoning it deserves. This is a win.

This finding is absolutely appalling:
"Neumark studied pay disparities at Nike using data the company provided to Hender’s attorneys during discovery. He concluded Nike had a gender pay gap of more than $11,000 per employee between 2015 and 2019."

They are appealing the denial of class status. This could be really big. Nike had a practice of paying people (not just women) their starting salary based upon their prior role’s pay. This caused many people to be paid below the minimum for their role. In 2018 7,000 employees were leveled up to the minimum. Because women tend to bear the brunt of the pay disparity, effectively this is the class of women who have been underpaid. Does it make sense to bring tenured employees to the minimum? They tried to call that good, but the reality is that it’s a boy’s club (in crowd/out crowd) mentality and they need to protect the men who decided they could “tinker” around with women.

@b6 Let’s not pretend all women at Nike got the same treatment. The company loved to market feminism, but in practice it often looked like favoritism disguised as progress. Funny how the loudest champions of ‘inclusion’ always seemed to be included.

Oregon allows punitive damages in personal injury cases, but they are rare and require proof of egregious or intentional misconduct by the defendant. Additionally, 70% of any awarded punitive damages must be paid to the state.

Imagine if they ever shined a light on Nikes DEI program and multiple overpaid changing heads. JS and all his successors have been a joke. And talk about discrimination….JS lead DEI and used his power and connections for evil against Nike employees

The result? A company that once obsessed over making the best gear for athletes now spends more time chasing cultural relevance and lifestyle branding. When your biggest strategic debates revolve around collaborations and marketing buzz instead of breakthrough products, don’t be surprised when innovation starts looking like a PowerPoint presentation.

@OP I think that this might empower employees to come forward knowing that Nike HR and Legal won’t protect us, but the truth doesn’t lie. Put it in the hands of a jury and Nike looks like the fool. The boys club is still out there! JM is #1! Nothing has changed.
