Thread regarding Chevron Corp. layoffs

Time to get a lawyer, please advise

Got let go today from MCBU, never had a 2- or 3 in my entire 20 years career with Chevron. Was I targeted for my age or for my high pay? I did not sign and will not sign any severance papers as I have enough cash to survive for about 2 years.

My problem is about the unfairness of the process. I am getting a lawyer. Do I have a case? Some of the labor laws stipulates that a "fair and consistent" process should be used. Many 2- in the company are not even part of this RAE, just CNAEP I am not a 2- or and I still managed to make the RAE list. What gives? I can't get my head around this one. I have no problem with moving on but man the process SUCKS and I wish it was fair.

I already emailed John Watson and Joe Geagea and I will be very curious about their answer, if any for that matter.

Any other good resources besides EEOC? There are many lawyers that will do a free initial consultation. Get a second opinion for free too. You can get your answer there rather than this forum where ANY one can post.

File. They did target older employees. They mixed in younger ones to make it lappear age discrimination was not at play.

Shit go sue if you want, don't worry about your future, burn up all your money and maybe if you never sent an inappropriate email, never read cnn.com on your office computer, never texted your office crumpet dick pics, always quantified your pmp achievements which covered your costs plus millions then you might get a settlement equal to the value of the package you did not accept 4 years earlier. I feel that I do an excellent job and earn my keep but I also would prefer not to relive some poor choices I made using company computers, phones possibly meeting rooms and stair cases.

All laid off personnel over a certain age (40?) should have been given a list of all personnel laid off by position and age, not name, so that you can determine if age played a significant role. If you did not receive this list, ask HR for it. In the past, I have seen that these lists have a good range of ages just to avoid discrimination lawsuits and this may explain why people with higher ratings make the list subjectively.

Agree with Robin M. Blind and others who advise to not bother with legal action. As others have counseled, you must begin with the EEOC. Unless you're a minority or a female with breast cancer, the best you'll get from EEOC is a notice of Right To Sue, which is NOT as good as it might initially sound. Then, you start to spend some money. Only,... at that point, you're operating under a different set of statutes, with vastly lower limits of total possible award, and the possibility of actually winning is probably less than 10%. In the immortal words of Bob Dylan,... "Twenty years of schoolin' and they put you on the day shift,...Look out kid they keep it all hid, better jump down a manhole light yourself a candle, don't wear sandals, try to avoid the scandals, don't want to be a bum you better chew gum, the pump don't work 'cause the vandals took the handles."

Just walk away and try to find peace, within.

I'm here to echo what most of the posted repliers are telling you: It doesn't MATTER if you 'have a case'.

You will NOT out-lawyer Chevron. Even if you 'win', you will FEEL like you lost.

I know what you're going through...and I'm sure it ISN'T fair.

But be realistic. Do NOT burn any bridges. Be nice. Take what is offered. Smile and move on.

This isn't a movie. It's your life.

I think they like to think everyone will feel it won't be worth it but if you start with filing a claim with the EEOC (which you don't need a lawyer to do), there decision week determine if your case has any merit. If they determine you do, then get Lawyer and file a complaint against them. They will likely offer you a bigger package to get you to go away. Remember, the burden of proof is on the employer, they will need to prove they didn't target older workers and I'm really not sure they can.

Your supervisor had to rate you at mid year pmp and report of you were 'trending' towards a 2- this year. Some people in my BU were on the list and had also not had a 2- or 3 before.

CVX has deeper pockets and more lawyers than you do.... and they have been preparing for this. Probably better at this type of thing than finding oil and floating spars.

Move on, don't look back..... you will forget the wretched place soon enough.

I just got mine today from MCBU as well. 6 weeks off with full benefits and severance for 8 weeks after the end of the 6 weeks.

Sorry to hear you were let go. Hopefully everyone realizes that most of the decisions are not personal for sr mgt as they are trying to get the right org in place to deal with the possibility of low oil prices for an extended period of time. I have seen where personal differences do come into play as to who stays and who goes but how do you prove that? You have cash reserves for two years, sign your papers and you will have cash for three years. You don't want to wake up in 2018 still dealing with being laid off in 2015. Just move on, focus on your future and what life has lined up for you. This is just the beginning of the lay offs and alpha will not be the last, more to come for sure, 2016 will make 2015 look like a day in the park.

Stay positive and keep in mind you have relative financial security compared to some folks who just got walked out of the buildings today. Don't give this company anymore of your energy, they don't deserve it!

You can possibly sue for age discrimination. You may have a better outcome if you get similarly affected co-workers to go along with you in a single case. It won't be easy and I guarantee it will take more than 2 years to get it to court. The best you may get from Chevron is a settlement agreement that will be only a little more than what you'd get with your severance check. Your chances of winning anything substantial is less than 5% in your favor. Just take what Chevron is paying and move on. Once you get another job, you will soon be thankful to be gone.
