Thread regarding Bank of America layoffs

BofA Paid me twice....

I just got Laid off from Bank of America (9/2017, after 25 years). I received my severance as stated, but now they say that due to "Late submission/Processing of Separation Information", they duplicated a paycheck, basically a double pay for unused Vacation, PTO and a couple days regular pay.

Based on my understanding of California Law, and after some rudimentary Google searches, the Banks sole remedy is to sue me, obtain a judgement and garnish any non-existent wages ( I took lump sum and I have retired and don't plan on going back to work, so no future wages).

I'm thinking I'll take my chances in front of a Judge and public opinion....

Opinions?

Do the right thing, but make sure they’re right. If you have a Bank of America acct they may just take it back so you know.

withdraw the money, close the bank account. change the telephone number or use a different one for the next 3 months. Treat that as a bonus, you need to return nothing.

Ya I’d just tellin to go screw themselves. It will cost them way more to sue you and they will huff and bluff but will eventually go away

Am thinking you just might be off the hook:

Ca Labor Code Sec. 221

It shall be unlawful for any employer to collect or receive from an employee any part of wages theretofore paid by said employer to said employee.

(Added by Stats. 1937, Ch. 357.)

I wouldn't call them or anything. At the least let them figure it out & prove it.
