I just got Laid off from Bank of America (9/2017, after 25 years). I received my severance as stated, but now they say that due to "Late submission/Processing of Separation Information", they duplicated a paycheck, basically a double pay for unused Vacation, PTO and a couple days regular pay.
Based on my understanding of California Law, and after some rudimentary Google searches, the Banks sole remedy is to sue me, obtain a judgement and garnish any non-existent wages ( I took lump sum and I have retired and don't plan on going back to work, so no future wages).
I'm thinking I'll take my chances in front of a Judge and public opinion....
