Read! Dont think everything so peachy with the merger. This will way on the judges opinion heavily. He opposes and cvs appeals, will take years to figure everything out. This possibly could be too big of a bite to swallow

Funny this has yet to be discussed on the transitions page! This judge sees right through the greedy tactics!! The list of witnesses are due by next Friday. So far the only ones they have are the 7 reliable witnesses going against the merger. My popcorn is popping and I will be watching!

Not for nothing, but some of these anti-competitive concerns have serious merit. Their was a documented case where an Aetna insurance consumer was forced to use CVS for their pr-scrip-ions rather than the pharmacy they were using. They were told by Aetna that they can only use Cvs for their pharmacy. This was specifically something that CVS said wouldn’t happen. Cvs said publicly that you’ll still be able to use your own pharmacy as an Aetna consumer, and clearly that’s not entirely true. Here is link to forum...

The witnesses are well qualified to be speaking about the merger. Most are phd or md, all backed by the AMA, i agree that it could get sour quick. Typical CVS, acting first and not thinking. Company is such a reactive not a pro active company.

Oh snap! That article is damaging big time to the merger, if those witnesses manage to sway the judge in the direction of rejecting the merger, a direction ironically he is already leaning! I have felt that this merger was doomed right from the start, as the judge was piss-d off at both CVS and the Gov’t from the very first court hearing. And EVERY time they asked him to just approve the merger he said no, and ordered another court hearing. For everyone who thinks this is nothing but a show, open your eyes and see that yes this merger IS in trouble! To the person who said that there is too much money invested in this, that is not the judges concern. A merger is supposed to be considered on its own merits, not on how much money is invested. That cvs spent $69 billion on Aetna has NO basis for a court decision, because then you could make that argument for any merger, that we have too much money invested, so you have to approve it, or we will lose money. The truth is, CVS-AETNA finalized the merger BEFORE the judges approval and now their paying for that! And instead of apologizing to the judge, they made it worse by expecting judge Leon to approve it anyway, regardless of how he felt. Rule #1... Never p-ss off a federal judge! CVS is learning this the hard way!
