Oh snap! That article is damaging big time to the merger, if those witnesses manage to sway the judge in the direction of rejecting the merger, a direction ironically he is already leaning! I have felt that this merger was doomed right from the start, as the judge was piss-d off at both CVS and the Gov’t from the very first court hearing. And EVERY time they asked him to just approve the merger he said no, and ordered another court hearing. For everyone who thinks this is nothing but a show, open your eyes and see that yes this merger IS in trouble! To the person who said that there is too much money invested in this, that is not the judges concern. A merger is supposed to be considered on its own merits, not on how much money is invested. That cvs spent $69 billion on Aetna has NO basis for a court decision, because then you could make that argument for any merger, that we have too much money invested, so you have to approve it, or we will lose money. The truth is, CVS-AETNA finalized the merger BEFORE the judges approval and now their paying for that! And instead of apologizing to the judge, they made it worse by expecting judge Leon to approve it anyway, regardless of how he felt. Rule #1... Never p-ss off a federal judge! CVS is learning this the hard way!
