Thread regarding Imperial Oil Limited layoffs

So it seems that the majority of folks are planning to fake mobility to see what they are offered, even if they have no intent to move. Is this the play? If I declare immediately I am not mobile, and seek immediate severance, will I be severed sooner than if I wait to see? I can't wait to GTFO.

@rp this scenario answered in FAQ the employee would not be eligible for severance.

@a3 also if you have performance numbers you will not get relocated unless you have some incredibly specific skills that are critical to an operation or project that may run another 2 to 3 years. Then maybe maybe but soon you would be let go in Edmonton vs. Calgary.

@OP another scenario I’ve seen here previously is an individual saying yes to mobility and then accepts a job offer with relocation but later backs out before the new job start date and move. Very tough in this situation the individual should get more than basic severance but people want or expect the best of everything without risk. It doesn’t work that way.

I honestly don’t see how this doesn’t become a circular circus with people moving everywhere.

The site-based folks were told to answer the survey with other location mobility. If the staffing council does not select them for a role in the new org at their current site, though would be considered for a role at another site from their survey…
So after 2 rounds of Calgarians saying yes-then-no, then you’ll be moving people between sites? Will it be the top performers country-wide displacing the lowest performers?
PDS in 2028 will be brutal.

@eh Are you going to do a story about the outsourcing of high paying jobs to unqualified, low paid and ineffective people in poor countries?

Thats the real story here.

My experience with the overseas business centers and technical center is they are awful. They make those working at sites and in Canada do more work to fix their mistakes or work around their low quality of work.

Then more jobs get outsourced.

The flow chart is definitely weird. Anyone with HR insights want to comment? Or perhaps some anonymous HR folks trying to do the right thing for others? Maybe help out your colleagues for once (maybe the last time).

@e2 people please don’t pretend to be lawyers. Everyone should get their own employment lawyer. It’s one of the biggest decisions of your life. Arm yourself with the experts. Everyone’s situation is different. People have different employment contracts. Also, some may be offered a role but it’s a demotion, some may be offered a role that is a promotion. All these different variables will impact your severance amount.

I am not a lawyer, but according to multiple articles published by law firms, if a company changes your role significantly this is constructive dismissal.

My thoughts are that if you say yes to relocation and are offered your same job, there is a big risk that they will reduce your severance if you decline the move. However, if you say yes and they offer you a different job and you say no, then severance should not be impacted because it is a change in roles which is constructive dismissal.

I think if you say no upfront, you have higher chance of getting common law severance (higher).

If you say yes to relocate and theb decline, the company has it on record that you were able and willing to move, you had a job position available, and YOU chose not to take it and company did everythibg they possibly could. With that documentation in hand, i could see them arguing for bare bones legal (8 weeks max).

To me, it seems sneaky and a trap. I dont like the flow chart…

@b4 the org is not yet setup with no names in boxes. That’s just beginning. Confirmed with a supervisor.

The list of employees to be retained have already been finalized and the minimum organization structured around the availability of those protected species. Shed the countless managers and supervisors in the above field organization. Many of them were supported by competent staff and way overpaid for their non-conteibutions.

If you say you are mobile and then offered a move in current role or similar and turn it down it coukd be deemed a resignation with no severance so dont say yes the he'll of it.

Be self physically and mentally prepared to train BTC or Houston folks before severance pay out period starts if it has been determined and needed. They want smooth transition! Ohh and for next year’s “we are ExxonMobil” survey, please take your “valuable time” to do it.

@a6 there is. They’re trying to change the terms of your employment contract to state you’re willing to relocate. The relocation is constructive dismissal and should increase severance, will most likely need a lawyer for that. The amount that will be share soon is the bottom….

Being able to fake it now, get selected, back out of it and still get severance seems too good to be true. There must be a forgone legal right to say you’re mobile, then later decline.

Honestly - they just asked everyone because they dont want to single out individuals they are interested in taking to Edmonton.
I dont think your answers are going to matter much if you aren't on their short list.
